Welcome to Eat, Sleep, Poop (“Service”), operated by BTW LLC (“we,” “us,” or “our”). By accessing or using the Service, creating an account, or purchasing an activation code, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

1. Description of Service

Eat, Sleep, Poop is a tracking tool for logging feeding, sleep, and diaper-related information for infants and young children. The Service is provided for personal, non-commercial use to help caregivers coordinate and record care activities. The Service is not a medical device and is not intended to diagnose, treat, or prevent any condition.

2. No Medical or Professional Advice

The Service is for informational and organizational purposes only. It does not constitute medical, health, or professional advice. You should always consult qualified healthcare providers regarding your child’s health. We are not liable for any decisions or actions taken based on data or information entered into or derived from the Service.

3. Account and Use

You are responsible for maintaining the confidentiality of your account and for all activity under your account. You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to harm others, violate any law, or transmit malicious or illegal content.

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BTW LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless BTW LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We may modify the Service or these Terms at any time. We will indicate the date of the last update at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any dispute shall be resolved in the state or federal courts located in Utah.
